Why is Kelly Services being sued?
Kelly Services is one of the largest employment placement agencies in the United States. They have approximately 60 offices that provide placement services for clients and candidates, including companies and individuals. They place candidates in jobs all over the United States and, increasingly, internationally. They claim to place more candidates per year than all other private placements combined.
They do this by filling positions with a vast range of candidates. This includes both individuals that have recently become unemployed, as well as people that want to find work, especially in hard-to-fill positions. For those not familiar, a candidate placement agency uses its network to match skilled, experienced professionals to businesses needing their skills. The agencies also pay the recruiters they use for locating employees.
While Kelly Services makes a living out of matching businesses to candidates, there are a lot of people that say it is not done right. They have been investigated and sued by both the New York Department of Labor and the Equal Employment Opportunity Commission because they allegedly discriminate against disabled individuals. In particular, they pay employees a smaller salary when their work requires them to be on their feet for more than eight hours a day. This type of discrimination is called disparate treatment.
Another form of discrimination is what's called disparate impact. This is where an employer, in this case Kelly Services, has the intent to hire individuals, but has no choice in which individuals they can hire. Disparate impact means that the way an individual or an agency selects candidates leads to a higher probability of hiring a disabled individual.
Why would this be a problem? Individuals who are disabled in the United States face a myriad of challenges. Some have physical limitations such as an inability to walk or an extreme difficulty seeing, while others have mental health issues, making it difficult for them to get a job or even to take part in typical social activities.
Some have more severe disabilities, and it seems that the worst effects have the most severe types of disabilities. For example, studies show that disabled people are less likely to live near their families, and more likely to die alone and destitute than in any other group in society. People with chronic illness may die sooner than people without disabilities.
One of the reasons why this discrimination happens is because certain types of disabilities are considered more disabling than others.

How long does it take to get paid from Kelly Services?
I am a client and am wondering how long it takes for my pay to show up in my bank account? I know what their cut is, and they do not pay before the 4th week of the month. So the pay would have to be there by 3rd week. Or is that not how it works?
Yes, a client may ask a question about his/her compensation, and I should respond to any question about it, including what information you can provide and what time it shows up in your bank account. You can read the compensation policy in full here. Clients typically are paid in three ways:
A pre-deposit bonus. A deposit bonus when you begin a job. A direct deposit into a client's payroll. It's really nice when they don't have to deposit money into a client's payroll, but a lot of clients prefer it that way. In some cases, the pay will be "direct deposited" into their bank account, but it won't necessarily be in their bank account immediately. It may take a week or two. This will be indicated by "Payment pending" next to the client's name on the client panel at Kelly. Clients also know whether they're being paid weekly or bi-weekly and, sometimes, how much those checks will be each week. Clients are often paid by direct deposit if their check has been delayed or there are other circumstances such as "payment issues."
The client does have to request the money be deposited, so usually a couple of days is adequate time to request it from him/her. To answer your second question, if a client is paid on the fourth week, we always make sure they receive it by the third week, so by the time they get their paycheck, it should show up in their bank account. If they work the last week, they'll get paid with the 3-week payment on the 6th week of the month.
Also, if a client is late with a deposit, they need to call my client account manager, Sarah, who is excellent about keeping them up to date and reminding them of when payments come through and when deposits are due. They then tell her to send out notices to them saying that something came through in their account. The client then can call our client account manager, she's extremely efficient in this regard. She'll make sure to follow up with the client regarding payments.
