What is proxy voting?

In a general election, some or all of the votes cast by eligible electors are transferred from their usual place of residence to a different place of residence, commonly known as 'proxy voting'. On behalf of an elector who wishes to vote by proxy, the electors make a signed statement as to the place of residence where they wish to have their vote transferred. The law sets out the following requirements: a statement must be made in accordance with subsection (1);. A statement must be made to a minister, a nominated person or a registrar;. The statement must set out the name, address and electoral roll number of the elector;. The statement must be signed by the elector, and in the case of an elector who is in Australia on a visit of a temporary nature, the statement must be signed by the elector or, in the case of a minor, a guardian or a person acting in his or her place;. The statement must be made on a form approved by the minister; and. The form must be available at the registrar's office. The law also specifies that the proxy vote of an eligible elector may only be transferred to a place of residence other than the place of residence where the elector would have been entitled to vote in that electoral division. A proxy vote is not transferable to another elector. What can a minister do with the information provided by the elector? A minister may not do any of the following things with the information set out in the proxy statement: reveal any part of it to any person other than to a person nominated under subsection (2);. Use or disclose the information in connection with any electoral matter or other matter within the minister's jurisdiction; or. Do anything with the information other than to deliver it to a registrar. A minister may not transfer the information to a person who would be within section 14.1 (1) of the Electoral Act 2022 (Cth), but a person nominated under subsection (2) of that section must do so within two business days.

A minister who has received a proxy statement may deliver it to a registrar.
