Are web scrapers legal?
And are they always a bad thing to use in your scrapping projects?
You can argue that it's perfectly legal to scrape web pages and use the contents of web pages to your use. But, don't you want to know who owns what data on the sites you're scraping? When you use the scraped data for anything, that becomes a sticky situation. You never know whose data it is really, so what you do with the data legally becomes an ethical problem. You cannot take credit for other people's information or use that info with intent to gain financial advantage over the original author.
Even if you're not trying to make money, this can be an issue; if someone makes their name based on their online presence, any scraped data from a project that used that as part of it's searchable content might confuse people about the attribution. It's better to have a disclaimer in writing, but the person(s) affected may be on good behavior most of the time anyway, so there may not be any action taken against them.
What is the best way to handle this? What if you accidentally scrape somebody's account by mistake? What about when multiple people are scraping the same thing together? Is scrapers legal? I think not and should be treated like what they are which is a blackhat SEO tactic. The scrapers aren't using any bots or code that has any automated method of extracting pages, data, text etc. So my feeling is that this practice should be regulated by the authorities in a controlled manner similar to how botnets are handled these days and there should be serious repercussions for such activities as we are all affected in some way shape or form or perhaps more than just that for some.
As far as scrapping goes I think any individual or group that is using this method and taking any sort of credit for the material as opposed to the original developer has crossed the boundary into a gray area. I think it may even be a criminal activity.
I'm sorry but scrapers are stealing the information which belongs to their owners and it cannot be justified using any legal argument. In these days, we've advanced to the age where internet is completely different, and it's up to the users and websites. If you want something and put your precious time for it, who cares who stole it! Scrapping it will make anyone remember about his/her name!
