It's all about how much they will allow and the risk of them shutting you down. As you've probably noticed on that page, it says that in certain countries (read: China) you're limited to 50Kb/s and so on, but this hasn't been enforced in the last year or two. What they will try to enforce, however, is whether you're really uploading all that data.

If you only upload once a week and keep things light, I wouldn't worry about it. But if you upload all the time, you're risking getting suspended.

Now to your question: Can they catch you? Yes, they can. They're probably checking your IP more than you are. But if they do shut you down and your IP doesn't match their logs, you'll have a problem. You can mitigate this by hiding your IP, but this is something you need to be aware of and not just blindly trust.

If you do it though, they'll know because it will log on their servers (unless you use OpenVPN, which doesn't leave tracks at all). But again: I wouldn't worry about it too much. As long as you're not uploading a lot of data and are still safe then you're okay. I'd rather have my internet connection suspended than get someone arrested for having downloaded some data.
