It's not really a question of "why" or "how". They simply don't want to have to deal with the liability of hosting a VPN server. For all the reasons detailed in the USFSA ruling, they can't hold ISPs liable, they have to pass it off on the VPN service.

This does not, however, mean that VPNs are banned, just that Netflix doesn't have to be involved with them. All they need to do is provide a server that the VPN client can connect to.

If you want to use Netflix with VPN, I'd suggest a provider that meets this requirement (not all VPN providers are good - if you have to pay for it, choose one that doesn't require a lot of money for support). I have been using ProXPN, but others include Private Internet Access, ExpressVPN, and many more.
