Is it legal to scrape indeed?
Does scraping indeed infringe copyright laws? I know it is not the same as a full download of the content and that some sites are against scraping. But, I do not understand if it is legal or not to just download the text from a website.
For example, if I scrape an entire page and put it into a text document, will I be in trouble? (And is it legal to do so?). If I am doing this for research, will I still be in trouble? And, in general, does scraping itself infringe laws? Thanks. C. Is going to be a college student in Fall 2023.
Dear C., The following excerpt from a comment on the U.S. Copyright Office's Website clarifies your question:
Quote: This office has received several questions concerning the legal effect of a program or device that makes it possible to make a copy of information stored on a computer without physically accessing the storage device itself. The copyright law does not make it unlawful for someone to duplicate information located on a computer. However, a person who duplicates or downloads a work from a computer is subject to liability under the copyright law. If a work is scraped, downloaded, or otherwise copied from a website that contains copyrighted material, then a person who is the subject of that copying may have a claim for infringement.
The question of whether the act of downloading from a website containing copyrighted material is legally prohibited by copyright law is a question that this office cannot answer. The answers to that question depend upon the facts of each case and the particular activities of the person making the alleged infringement. It is also important to remember that the question of what constitutes an infringement is not simply a question of copyright law. As a practical matter, it is often a question of whether the copyright owner's rights have been harmed, or whether the action of the person accused of infringing is so harmful that a court should impose sanctions.
If you are uncertain whether your activities are legal or not, the safest thing to do is to seek advice from an attorney who specializes intellectual property issues. Answers. Yes, in a sense you are infringing copyright by downloading the text from a website. The copyright owners have the exclusive right to decide who can make copies of their work.
