What are the legal considerations for web scraping?
If you read the article, you will see that the discussion was about a scraping website.
I'm not sure whether I should add web scraping to the title of this post.
Anyway, the question is: what are the legal considerations for a web scraper? In my opinion, there are two main aspects. The business aspect. The legal aspect. If your scraper does not make money, then it doesn't matter if the business aspect is important. You might want to find out how to make money, but if you do, then you have to find out the business aspect first.
But if your scraper makes money, then both the business and the legal aspect are very important. Note: this is a very simplistic overview of the subject. I haven't had time to do any research on the topic, so please read more about the subject if you want to learn more.
The business aspect. If you don't make money, then it doesn't matter how you design the code. It is not your job to make money.
If you make money, then you can do whatever you want. The only thing that is forbidden is to collect all the data in order to sell it to others.
The legal aspect. If your scraper makes money, then it is possible to get sued. For example, if you are selling the content of a website, then this is legal. But if you are scraping a website in order to use the content for your own purpose, then you might be infringing the copyright of the website.
In general, the web scraper cannot be considered as a business. If the scraper makes money, then you might get sued.
Note that this is only my opinion. There is no official statement about the legal aspect of web scraping.
My opinion is that if your scraper makes money, then you have to look into the business aspect and the legal aspect. Otherwise you are taking unnecessary risks.
Have fun! Update. There is a web page which looks at the legal aspects of web scraping. You can see that they say that web scraping is legal if you don't make money.
Is selling web scraped data legal?
I'm pretty new to scraping data and would like to ask if it's legal to scrape public web data.
As in: I'm a personal and free user of the website that I scrape and I would be happy to share my findings with you.
For example: an insurance company who wants to know the age of the average person who buys their policy. I take the average age from the data that the insurance company provides, then calculate the ages of my users who have made insurance purchases. Is this okay? I feel like this could be seen as scraping.
Thanks for the question! I'm sure the insurance company doesn't mind, but would you still be able to take credit for the data? I just want to make sure that I do the right thing and don't get into trouble with the site owner. Thanks for clarifying that you are not planning to charge for the scraped data. You will likely have to pay for a license to scrape a public site.
If you're using a publicly accessible web site, you can be sure the owner has no intention of charging you for their data. It's likely that the owner does not know what you are doing with their data and is having the data scraped simply because they can.
The insurance company likely has permission to collect data and make it available for their purposes. They may or may not have permission to make it available to others. The insurance company could request that you send them a copy of the scraped data in exchange for permission to use it. If so, it's probably best to just send them a copy of the data.
It's also possible that you could find that some insurance company employees plan to charge for data that they offer to others. If that happens, you should approach the company and explain that you plan to use the data freely, with no intention of ever charging the company for it.
I hope that helps. Good luck with your scrapes! Thank you for the reply. My concern about selling the data is that the data gets too old very quickly. The data I'm getting is about 10 years old (or less) and I get older and older data as I go on and the data gets older.
