In my experience, the passcode restriction only appears when your phone has been jailbroken, so it's either that or your phone is really old. If you've got some time and you're willing to spend it, you can probably figure out what the passcode was, and the lock it off with iTunes. There's a program called iPhone Passcode Unlocker which will do the job. I haven't tried it, but I'm pretty sure it'll work for you. If you know what the code was before it was set, you might be able to recover it by trying all the codes that were available to the previous owner. You could use another cell phone as a reference, or you could try to reset the phone to factory defaults (Settings > General > Reset > Erase All Content and Settings). But that might be a little more of a pain than just using iPhone Passcode Unlocker.
