I have been wanting to start a thread on the topic of scraping, or 'scrape', for some time now, so finally I did.
I also wanted to do this right away because I received a lot of feedback, which was really appreciated. It has made me realise I need to think about things first, and that's not always a good thing - it'll be easy to do a 'good enough' job!
Before we get started, I'd like to make a few things clear: Scraping is legal. Scrape any site you want, as long as you own the copyright to the scraped content. That means you can't scrape a site without an individual licence for each page or image of that site.
I don't believe you need a licence for a commercial use - you are just taking content you already own. See my comments in response to my first question below.
You don't need a licence for personal use. I'm not saying you should, or even should you scrape. But a company making a web app, especially with a database of images, might consider it legally required to have a licence for commercial use, but that's your call.
It's not legal to scrape sites you do not own the copyrights of. If I was to go to Flickr and screenshot every photo in one of their galleries, it would be stealing, even if I'm putting those photos back on my site.
There are many other issues to cover here, but I'll try to address them in order from the top. I've tried to keep them straight as I list them, but if you find I've missed something, let me know and I'll rectify it ASAP.
So, first question: ? Yes. You're not violating a site's terms of use if you're using the content within the site legally. This includes screenshots of websites. So, yes you can legally scrape them.
The only case where you shouldn't scrape is if the website specifically says you must not (ie. They sell licences for this use). This would be like, say, an auction site telling you can't take pictures of an auction item for a newspaper article. This is a specific situation and clearly stated, so if there is any ambiguity in this, it could be a tricky question.

Twitter and OAuth. Twitter provides a service where you can create a free account on their website. You can create an account and start using their service. Twitter then provides an API that you can use to access their system. You can send and receive text messages on Twitter from your own computer, but you have to do the following things to use it.
Visit the Twitter website at. Click on the "Sign in" link to create an account. A new page will appear on the screen where you can enter the information about your new Twitter account. You are asked to enter the name that you would like to use, your location, and an email address. You can use any email address that you have in your own personal email system, but it must be one that is used only for Twitter.
You can set the location of your new Twitter account with the latitude and longitude. For example, "51.4,-4.8" means the United States of America, with latitude 51 degrees and longitude -4.8 degrees.
When you click on the "Create an Account" button, a new window will appear. The screen shown in Figure 4.1 will appear. This screen allows you to choose from a list of languages in which Twitter will display text messages.
Click on "English" and then click on the "Create Account" button. If you click on the "Create Account" button, you will be directed to a page where you can create a new account. This will show you the same page that you saw when you first visited the Twitter website.
You will be shown a page that looks like the one shown in Figure 4. Enter the name that you would like to use for your Twitter account. Click on the "Create" button. A new page will appear where you can enter your name, location, and email address.
Is it illegal to scrape tweets?
I've been hearing a lot lately about the legality of scraping, and more specifically TweetScraper (as they call it on their home page). The reason it's being talked about is because several high profile sites have been hit, including the Huffington Post and even Wikipedia (which is also a big web property, but one that I haven't been as aware of - thanks Wikipedia! I had no idea there were legal questions surrounding this software.
However, when I looked into the questions surrounding it, it seems to me that in the interest of helping people not hurt their sites with a bug in their code and possibly damaging their own domain name, all parties (webmasters and developers) should work out some legal framework. So what is scraping? According to Wikipedia, Scraping involves creating software tools to extract data from websites and databases, in a way that replicates human activities, such as searching for information (for instance in the case of web searching). Why would you want to scrape tweets and get rid of the real content? What would be the upside to doing this? Well, in this example, you could be seeing something new that your other followers aren't, but it also happens on Twitter itself, when you start searching for any particular term or topic, and suddenly discover an article that talks about it just a few hours ago that isn't even on the first page of results. Now we come back to the legality issues: You could be copying material that hasn't been published yet and that others haven't paid to see. At the same time, others wouldn't know about it, which could harm others if they use said content without knowing that someone was ahead of them. And if you do want to copy then you need a license. If you don't have a license, you probably can't copy it and then you must remove all access to it immediately.
In short, you won't legally be able to steal another company's website. Why does it seem so hard to explain that? This also applies to Tweets themselves - If you use any of those services, you do NOT have rights to them. As an affiliate manager I had to go through that process and it was extremely frustrating.
